When representing property owners and developers, Miles & Stockbridge’s comprehensive combined knowledge of commercial finance and the greater Maryland real estate market help ensure the successful consummation of the desired transaction. We represent a wide range of lenders, and regularly secure financing for commercial property development projects from:
- national, regional and local commercial banks;
- private equity lenders;
- mortgage companies;
- state and federal economic development agencies as sources of incentive financing;
- loans originated through programs of government-sponsored enterprises (GSE), such as Fannie Mae and Freddie Mac, and federal agencies, such as the U.S. Department of Housing and Urban Development (HUD); and
- lenders developing, financing, servicing and managing projects insured under the National Housing Act, including Sections 221(d)(4), 223(a)(7), 223(f), 232, 236, 241, and 242.
In connection with our representation of lenders, property owners and developers in real estate financing transactions, we are experienced in the preparation and negotiation of all required loan documentation, as well as the delivery and review of all necessary due diligence, including title insurance, zoning approvals, environmental assessments, leases, easements and other third-party agreements. While each lender has its own transactional processes and procedures, our work with a wide cross-section of lenders enables us to suggest customized terms and provisions that will allow the parties to overcome even the most difficult impediments to settlement, as well as build in safeguards that protect the lender and its collateral in the event of default, foreclosure or bankruptcy.
