Biography

Amanda Neidert Kesler’s diverse environmental law practice encompasses regulatory compliance and permitting, environmental and toxic tort litigation, and contaminated property transactions.

Adept at helping clients understand and limit their environmental risks, maneuver through compliance challenges, and achieve their business goals, she works on a broad range of environmental issues, including wastewater, solid and hazardous waste, air quality, and product liability.

She counsels clients on complex regulatory compliance issues involving various environmental statutes, including the Clean Water Act; the Clean Air Act; Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); Emergency Planning and Community Right-to-Know Act (EPCRA); Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), Resource Conservation and Recovery Act (RCRA); Toxic Substances Control Act (TSCA); and related state statutes.

Frequently working with clients to reduce their liability exposure by establishing environmental compliance programs, Amanda has guided clients in developing chemical accident prevention and risk management plans, coordinated multi-facility audits nationwide, advised on voluntary disclosures, and consulted on green marketing claims. She has extensive experience in stormwater and wastewater permitting, helping clients with toxic and hazardous chemical release and inventory reporting, and advising multi-family housing owners on federal and state lead disclosure and risk reduction requirements.

In the litigation part of her practice, she has defended clients in federal and state enforcement actions, environmental contamination litigation and administrative agency proceedings. She frequently represents potentially responsible parties (PRPs) in Superfund matters, including cost recovery and groundwater contamination actions as well as responses to CERCLA 104(e) information and access requests.

Amanda also regularly advises clients on environmental liability, insurance and due diligence issues related to real estate transactions and corporate acquisitions and divestitures. These include evaluating and resolving environmental compliance and contamination issues, advising on contractual terms, handling permit transfers, negotiating remediation agreements, and helping clients pursue property remediation under state voluntary cleanup programs.

Her clients include manufacturers and distributors of industrial and consumer products, real estate developers and property owners, private equity investors, real estate investment trusts (REITs), financial institutions, makers of alternative fuels, nonprofit organizations and small businesses.

She also has experience in federal regulations on motor carrier safety and transport of hazardous materials and has advised on broker, carrier and shipper cargo and liability claims.
