Occupational Safety & Health

Miles & Stockbridge represents employers throughout the country in matters before the Occupational Safety & Health Review Commission, the Mine Safety and Health Review Commission, the Department of Labor, and state courts and administrative agencies.

Our lawyers handle matters involving workplace fatalities, indoor air quality/mold complaints, ergonomics investigations, forklift accidents, anhydrous ammonia releases, lockout/tagout and machine guarding, and numerous other issues. We also assist employers in identifying and complying with applicable regulatory requirements by, among other things, developing written safety and health policies and programs, conducting compliance audits, and, most importantly, developing practical solutions to complex safety and health-related problems.

Clients look to us for guidance on issues such as hazard communication, fire prevention/emergency evacuation, lockout/tagout, machine guarding, hearing protection, workplace violence and recordkeeping.  In addition, we travel to client sites throughout the country to provide on-site training for managers and supervisors.  In appropriate cases, we work with engineering consultants and other outside experts to assist clients in conducting OSHA and MSHA compliance reviews.

We advise and defend clients in matters involving inspections conducted by OSHA and related agencies.  On numerous occasions, we have persuaded OSHA or its attorneys to narrow the scope of an inspection, or to terminate an inspection early and remove their personnel from our client’s worksite altogether.
