Kelly Robier wrote in the Bar Association of Montgomery County’s May newsletter about the U.S. Department of Justice’s proposal of a new process for evaluating state bar complaints against its attorneys, arguing it “subordinates state ethics investigations and proceedings to an internal DOJ-led process, potentially shielding thousands of DOJ lawyers from independent state investigation and warranted disciplinary or remedial action.”

Kelly, a member of BAMC’s Ethics Committee, says the new rule also “represents a dramatic change in the oversight and regulation of attorneys by the state in which they are license,” noting the Supreme Court has long left licensing and regulating of lawyers to the states.
