Two recent federal court decisions have helped to clarify the rules for parties seeking jurisdiction in federal court. Both decisions may broaden removal possibilities to federal courts in product liability actions.
In Hertz Corp. v. Friend, 130 S. Ct. 43 (2010), the United States Supreme Court resolved a split among the circuit courts of appeal and applied a uniform rule for determining a corporation’s principal place of business for diversity jurisdiction.
