Bid Protest Litigation

We represent clients in bid protests challenging a government contract award, as well as those seeking to retain awarded contracts.

Our lawyers appear before tribunals that hear protests, including the U.S. Court of Appeals for the Federal Circuit, the U.S. Court of Federal Claims, the Government Accountability Office and all agency-level protest proceedings, as well as representing clients in size and NAICS protests before the Small Business Administration.

Because effective bid protests often must be undertaken rapidly once an award is made, we quickly assemble the necessary information and file written submissions or pleadings to bring or defend a protest. We never lose sight of the fact that our client’s ultimate objective is to secure government business, either through a successful current challenge or defense or to establish the foundation for favorable future consideration by the purchasing agency.

We are equally effective at bid protests beyond the federal level. Our government contracts lawyers regularly pursue protest action under the laws of the State of Maryland and the Commonwealth of Virginia and we are familiar with bid protest procedures followed by additional states, interstate compacts and counties.
