Alfred M. Wurglitz
Biography
Alfred M. Wurglitz practices in two principal areas: government contracts and technology-related matters.
Government Contracts: Al counsels and litigates in the areas of government contract bid protests and disputes; technology commercialization and privatization; intellectual property rights; GSA schedule contracts; debarment and suspension proceedings; procurement fraud investigations and qui tam cases; contractor self-governance and compliance programs; and defective pricing and cost recovery.
For more than 30 years, Al has litigated before the Government Accountability Office, U.S. Court of Federal Claims, Boards of Contract Appeals, U.S. District Courts, and U.S. Court of Appeals for the Federal Circuit. He also handles bid protests and disputes involving state and local agencies, primarily in Maryland, the District of Columbia and Virginia.
Technology Transactions and Licensing: Al has extensive experience in technology transactions in the information technology, financial, insurance, health, energy, defense, pharmaceutical, biotech, petrochemical, manufacturing and retail industries. His transactional representations involve system acquisition, licensing and distribution, software as a service, custom technology development, drug development collaborations, e-commerce arrangements, and outsourcing arrangements. He represents clients domestically and internationally in technology joint ventures, joint development agreements, export controls, and other complex technology transactions such as acquisition and divestiture of product and service lines.
Al also advises on intellectual property protection for technology products and services. He litigates complex technology performance, copyright infringement and trade secret misappropriation cases, primarily in federal and state courts located in Maryland, the District of Columbia and Virginia.
Publications and Speaking Engagements: Al has authored many articles and lectured on technology development and licensing, bid protests, intellectual property in government contracts, contract disputes and remedies, federal financial assistance programs, contractor self-governance, outsourcing transactions, and open source licensing. He co-authored (with Sandra Conn) seven editions of the leading book on using the federal Small Business Innovation Research Program to commercialize innovative technology (1983-1992), and contributed two chapters in the first edition of Employment Discrimination Law (BNA).
Before joining Miles & Stockbridge in 2005, Al was a partner at O’Melveny & Myers LLP. He joined O’Melveny in 1993, after serving as General Counsel of a major systems integrator, technology developer and professional services company headquartered in McLean, Virginia. Al served in the Carter Administration as Assistant General Counsel, Executive Office of the President, Council on Wage and Price Stability. While finishing his law degree at Loyola University Law School at night, Al served as a procurement officer in the U.S. Air Force space program. Before then, he received a graduate degree in law and government from Oxford University in the U.K., studied law at New York University Law School, and received a Bachelor of Science degree from the U.S. Air Force Academy. Al served as a law clerk to the Honorable John Minor Wisdom on the Fifth Circuit Court of Appeals, and the Honorable William E. Doyle on the Tenth Circuit Court of Appeals.
