David R. Schaffer
Biography
David Schaffer develops integrated and independent patent, trademark, copyright and trade secret protection strategies and systems tailored to specific client needs and resources.
He leads Miles & Stockbridge’s Trademark team and represents clients in matters involving intellectual property protection strategy for obtaining, policing, protecting and enforcing patents, copyrights and trademarks. He also assists clients in identifying and resolving patent, trademark and copyright issues that arise in the computer (hardware and software), artificial intelligence (AI), internet, information technology, medical device, aseptic food processing, telecommunication and blast and ballistic protection fields.
David works with large, high-technology companies, small-to-medium-sized companies and universities, as well as with small startups and individuals. His patent experience includes the drafting and prosecution of computer hardware and software, AI, internet, business method, blast and ballistic protection equipment, mechanical, telecommunication, bioinformatics, biometrics and medical device patent applications. He is called upon to prepare patentability, infringement and invalidity opinions; perform due diligence investigations; prepare sale and licensing agreements; prepare, file and prosecute copyright and trademark registration applications; prosecute patent reexamination applications; and participate in patent, copyright and trademark litigation matters.
David and several other members of the Intellectual Property team have developed and implemented a highly configurable IP Strategy Standard Operating Procedure (SOP) and a related proprietary software program to manage client portfolios and third-party-prior publications.
David performs website review and analysis for copyright and trademark issues, prepares related infringement cease and desist letters, negotiates settlement agreements and represents clients before the TTAB in opposition and cancellation proceedings.
David has written and spoken on IP strategies for patents, trademarks and copyrights, the patentability of computer-related inventions, internet-related technology patents and bioinformatics patent protection.
Prior to joining Miles & Stockbridge, he was an associate with Kenyon & Kenyon and Banner & Witcoff. Before entering the legal profession, David was a consultant to the U.S. Navy for more than 16 years on numerous research and development, production and operational weapon, sensor and other hardware programs to include computer software/database development and support, computer hardware support, engineering, financial, logistics and management areas. David also taught high school chemistry.
