Biography

John T. Farnum has represented clients in all aspects of bankruptcy and creditors’ rights matters and related litigation in the District of Columbia, Maryland, Virginia and nationwide for nearly 20 years. He is a principal in the firm’s Washington and Tysons Corner offices.

John advises secured creditors, landlords, asset purchasers, indenture trustees, manufacturers, mezzanine lenders, officers and directors, unsecured creditors, trustees, special servicers, receivers and other parties-in-interest. His experience includes lender and borrower-side loan workouts, commercial real estate and Uniform Commercial Code (UCC) foreclosures and complex collection and judgment enforcement matters, including receivership proceedings in federal and state court. John has acted as a court-appointed receiver and substitute trustee in numerous commercial real estate matters.

His real estate litigation work includes complex commercial lease disputes, contract deposit and other acquisition-related disputes, mechanic's liens and other construction-related litigation, brokerage disputes, breach of fiduciary duty and other claims between boards and owners and foreclosure and receivership proceedings. John’s broader litigation practice frequently involves representing businesses and their stakeholders in business disputes, including breaches of contract, breaches of fiduciary duty, business torts, fraud claims and business divorces.

Outside the courtroom, John assists real estate clients with a variety of commercial real estate transactions, including financing, acquisitions, dispositions and leasing while also providing outside general counsel advice. He also counsels clients on fiduciary duty and risk issues as well as structuring and closing distressed transactions. 

John began his career as a judicial law clerk for retired Chief Judge Ross W. Krumm for the United States Bankruptcy Court for the Western District of Virginia. During law school, he served as a judicial extern for the late Judge Douglas O. Tice Jr., the former chief judge for the United States Bankruptcy Court for the Eastern District of Virginia.
