Defended Insurance Company Entities in FCA Lawsuit

Miles & Stockbridge defended insurance company entities in a lawsuit alleging more than 300 insurance companies violated the False Claims Act by failing to reimburse payments by private health insurers that participate in the Medicare and Medicaid programs.

Resolved False Claims Act Investigation Over Alleged Undeclared Import Duties

Successfully resolved a Department of Justice False Claims Act investigation against a yacht-sales company over alleged underdeclared import duties. After our presentation on the underlying regulations and duty calculations, DOJ closed investigation, declined to intervene in the qui tam complaint, and prevailed upon relator's counsel to voluntarily dismiss the underlying lawsuit.

False Claims Act Defense of Financial Services Company in Federal Investigation

Defended a financial services company during a federal investigation by the DOJ under the False Claims Act as well as inquiries by other government agencies and Congress. This “bet-the-company litigation” involved a claim of more than $1 billion. After a multi-year investigation, the government declined to intervene, and the case was dismissed. 

Defended Luxury Yacht Sales Company in False Claims Act Investigation

Represented a luxury yacht sales company in successfully resolving a False Claims Act investigation triggered by allegations of import duty underpayment. Following civil investigative demands from the Department of Justice and involvement of U.S. Customs and Border Protection, our strategic advocacy included educating government attorneys, including the associate chief counsel for U.S. Customs and Border Protection, on the proper application of complex import tax regulations and duty calculation methodologies. The comprehensive defense resulted in the government declining to intervene in the qui tam complaint and the relator voluntarily dismissing the underlying sealed lawsuit with minimal business disruption for the client.

Represented a healthcare company in Department of Justice’s investigation of alleged False Claims Act and Anti-Kickback Statute violations.

Defended a Major Government Contractor Against Alleged Violations of the Civil False Claims Act

Successfully defended a major government contractor in a jury trial in the U.S. District Court for the Eastern District of Virginia against alleged violations of the Civil False Claims Act brought by qui tam relators concerning performance of inspections under a telecommunications contract at an Army Base.

Representation of Health Care Provider in Investigation

Obtained dismissal of all claims against a healthcare provider in whistleblower action under the False Claims Act.

Represented a Major Corporation in a Case Brought by a Former Employee

Represented a major corporation in a qui tam case brought by a former employee under the civil False Claims Act in the U.S. District Court for the District of Columbia. The matter was resolved successfully after engaging in a mediation.
