Creveling v. Government Employees Ins. Co., 376 Md. 72, 828 A.2d 229 (2003). Court of Appeals affirmed denial of class certification and entry of summary judgment in favor of automobile insurer in class action lawsuit to recover personal injury protection (PIP) benefits.

CSR, Ltd v. Taylor

CSR, Ltd v. Taylor, 411 Md. 457, 983 A.2d 492 (2009). Court of Appeals affirmed grant of motion to dismiss based on lack of personal jurisdiction, holding that actions of foreign distributor did not constitute purposeful availment under Maryland law. 

Defended a CEO against Securities Fraud Claims

Represented a CEO of financial services company in defense of securities fraud claims.  We reached a settlement that was favorable to our client and breach of fiduciary duty was dismissed.

Defended a Global Manufacturing Company in Two Week Arbitration

Defended a global manufacturing company against numerous claims in a two week arbitration in Washington, D.C., securing a final award millions of dollars lower than sought by the claimant.

Georgia-Pacific Corp. v. Benjamin

Georgia-Pacific Corp. v. Benjamin, 394 Md. 59, 904 A.2d 511 (2006). Court of Appeals affirmed grant of summary judgment in favor of manufacturer of asbestos-containing products holding that express knowledge of exposure to asbestos products and diagnosis of mesothelioma constituted inquiry notice for purposes of discovery rule and commencement of limitations period for beneficiaries' survival action.

Johnson v. GEICO Cas. Co.

Johnson v. GEICO Cas. Co., 672 Fed. Appx.150 (3d Cir. 2016). United States Court of Appeals for Third Circuit affirmed decertification of plaintiffs’ classes and affirmed grant of summary judgement  in favor of automobile insurer in class action lawsuit brought to recover PIP benefits. 

Obtained Multi-Million Dollar Judgment in Protracted Commercial Litigation

We represented a Qatari businessman who was defrauded by his business partner in connection with a business park development in the Middle East. After protracted litigation, we obtained a multi-million dollar judgment in favor of our client.

Representation of Co-Owner of Multimillion Dollar Real Estate Enterprise

Obtained judgment in favor of managing member and co-owner of multimillion dollar real estate enterprise in dissolution and breach of fiduciary duty litigation following 15-day trial. Judgment affirmed on appeal.

Representation of Health Care Provider in Investigation

Obtained dismissal of all claims against a healthcare provider in whistleblower action under the False Claims Act.

Represented a Finance Company in a Counterclaim Class Action

Represented a finance company in a counterclaim class action in state court on claims arising out of the sale of AD&D insurance in connection with consumer loans.  After substantial motions practice and discovery, the case settled on a class basis on terms favorable to the finance company.

Represented a Hospital System in Patent Infringement Claim

Represented a hospital system in response to a lawsuit in the United States District Court of Maryland claiming patent infringement. We achieved a very favorable settlement within two weeks, with the entire settlement funded by a vendor of the allegedly infringing system.

Represented a Mortgage Company in a State Class Action

Represented a mortgage company in a state class action asserting claims for violating Maryland lending law in connection with the origination of second mortgage loans.  We successfully defeated class certification and the matter settled shortly thereafter on an individual basis.

Represented a Mortgage Servicer in Breach of Contract Litigation

Represented a mortgage servicer in litigation alleging violations of the Fair Credit Reporting Act and breach of contract, arising out of publication of derogatory credit information. We obtained summary judgment on all claims and the ruling was affirmed by the U.S. Court of Appeals of the Fourth Circuit.

Represented a National Consumer Finance Company in a Class Action

Represented a national consumer finance company in a class action alleging improper assessment of late fees. We obtained a dismissal of complaints based on improper claims splitting and we were successful in preserving dismissal on order of appeal.

Represented a Pharmaceutical Manufacturer in Contract Dispute

Represented a contract pharmaceutical manufacturer in dispute with contracting party. After conducting investigation into the facts and circumstances and confronting the other party with our analysis, the disputing party abandoned their claims against our client.

Represented a Physician Group in an Unfair Debt Collection Class Action

Represented a physician practice group in a federal class action alleging unfair debt collection practices in violation of the Fair Debt Collection Practices Act and the Maryland Consumer Debt Collection Act.  After obtaining dismissal of the class action complaint, the representative plaintiff appealed and during the pendency of the appeal, the parties settled on terms favorable to the defendants and without the physician practice group paying any money.

Represented a Test Administration Provider in Patent Infringement Claim

Representing an international test administration provider in defense of a lawsuit in the United States District Court for the Northern District of Illinois, claiming patent infringement. On August 18, 2017 the United States District Court for the Northern District of Illinois granted our client's Motion to Dismiss, finding that the IQS patent was invalid.

Represented an Automobile Dealership in a Deceptive Trade Practice Class Action

Represented the largest automobile dealership in Maryland in a deceptive trade practices class action asserting claims arising from the alleged failure to disclose the prior use of a vehicle as a daily rental.  At the close of discovery and just prior to briefing class certification, the parties resolved the litigation on an individual basis.

Represented Commercial Real Estate Developer in Commercial Lease Dispute

Represented a commercial real estate developer at both trial and on appeal in federal court in a complex dispute involving an early termination provision of a commercial lease.

Represented Defendants in a National Consumer Class Arbitration

Represented four defendants who provided back-office servicing to a credit counseling agency in a national consumer class arbitration involving alleged violations of the Credit Repair Organizations Act and a host of consumer protection statutes. Judgment was entered in favor of the class for 2% of the amount initially sought, and the arbitrator denied petitioner’s request for attorneys’ fees in excess of $7.2 million.

Represented Employer in Trade Secret Action

Represented a producer and distributor of chemicals in prosecution of trade secret action in the United States District Court for the District of Maryland against a former sales employee who copied several hundred sensitive documents to a portable hard drive before departing the company. We obtained a temporary restraining order and ultimately consent permanent injunction barring former employee from retaining and using client’s information.

Represented Global Furniture Manufacturer in Multiple Design Patent Infringement Claims

Represented an international high-end furniture manufacturer and designer in multiple suits involving claims of design patent infringement.

Represented Global Organic Feed Grain Importer in Governmental Investigation

We represented a global importer of organic feed grain in a governmental investigation when its international trade partner fraudulently sold our client non-organic grain. In an investigation that made national news, we managed a series of interviews with the United States Department of Justice that resulted in the USDA not pursuing any claims against our client.

Represented Loan Assignees in Federal Court

Represented several assignees of second mortgage loans in consumer class actions that were removed to federal court involving alleged violations of the Maryland Secondary Mortgage Loan Law. We obtained dismissal of the complaints on the merits and the dismissals were subsequently affirmed on appeal by the Fourth Circuit.

Represented Not-for-Profit Consortium in Contract, Trade Secret and Unfair Competition Claims

Represented not-for-profit consortium in response to contract, trade secret and unfair competition claims in Circuit Court for Baltimore City. We achieved successful dismissal of all claims in favor of our client.

We represented a preclinical pharmaceutical company in responding to multiple FOIA requests from PETA and other animal rights groups, arguing to various federal regulatory authorities why certain client data should be deemed exempt from requests. We have thus protected highly sensitive information on behalf of our client.

Represented several regional banks in federal class actions asserting claims under Maryland law involving allegedly defective repossession notices.  We successfully settled the claims in each case on a class basis on terms favorable to the banks.
